Terms of Purchase

These Terms of Purchase (“Purchase Terms”) govern the purchase of any product(s) (“Product(s)”) you order from JvSv & Co. via our Site. By placing an order with us, you agree to these Purchase Terms in full. If you do not agree with any part of these Purchase Terms, you must not place an order.
1. Definitions
· “You” means the individual purchaser who places an order.
· “We”, “us”, “our” means JvSv & Co., a Wisconsin corporation (or entity) operating the Site.
· “Order” means your purchase request placed through our Site, which we accept under these terms.
· “Purchase Price” means the price of the Products plus shipping, applicable taxes, duties, handling or other charges (if any).
· “Confirmation” means our email to you confirming receipt of your Order (but not yet (or not always) confirming acceptance).
· “Acceptance” means when we dispatch the Product(s) to you or otherwise confirm that your Order has been accepted and will be fulfilled.
2. Order Process
All advertisements on the Site are invitations to purchase and not offers to sell. We reserves the right, at our sole discretion, to accept or reject the order once the order form has been completed and submitted.
When you submit an Order via the Site, you agree to provide current, accurate and complete information (including billing, shipping address and payment details).
After submitting your Order, you will receive a Confirmation email from us. This Confirmation does not necessarily mean we have accepted your Order — we may accept, reject or cancel your Order at any time (for example due to product unavailability, pricing error, verification process or suspected fraud).
We accept your Order when we dispatch the Product(s) or send you a separate email stating your Order has been accepted. If we cancel your Order after we have charged you, we will refund the full amount within a reasonable time (but we are not liable for any other costs or losses).
3. Pricing & Payment
Prices shown on the Site are in U.S. dollars (USD) and are subject to change without notice. The price applicable to your Order is the price in effect at the time you submit your Order (unless we notify you otherwise).
You are responsible for all applicable sales tax, and if shipping to certain jurisdictions, any duties, customs or import taxes.
Payment must be made at the time of placing your Order; we accept the payment methods displayed on the Site (e.g., credit card, PayPal).
You represent and warrant that you are authorised to use the payment method you provide and that the payment information is correct.
If payment is not authorised, or if we suspect fraud, we may cancel your Order or refuse shipment.
4. Shipping & Delivery
We operates with a sustainability-focused approach. Our limited-quantity and small-batch production model is designed to minimize waste, reduce excess inventory, and support responsible manufacturing. As a result, some items—especially made-to-order or handcrafted pieces—may experience slightly longer preparation times prior to shipment.
We will ship Products to the shipping address you provide. You are responsible for providing correct and complete shipping information and for any customs, import duties, taxes or other charges in your jurisdiction (if applicable).
Estimated delivery times are provided on the Site at the time of purchase; however, these are estimates only and we are not responsible for delays caused by carriers, customs or force-majeure events.
Ownership of the Products passes to you when we deliver them to the carrier for shipment (unless otherwise agreed). The risk of loss or damage passes to you at that time.
If the Product(s) are not delivered within 90 calendar days after Acceptance (or such other period as required by applicable law), you may contact us to arrange a cancellation and refund (subject to the rest of these terms).
Please inspect your delivery upon receipt. If you receive damaged or incorrect items, you must notify us within 14 calendar days of delivery at jvsvandcompany@gmail.com.
We cannot deliver to Russia.
5. Returns, Exchanges & Refunds
Unless otherwise specified (for example made-to-order or personalised items), you may return or exchange Products that are unused, in original condition and packaging, within 14 days of delivery. Shipping costs for returns/exchanges may be borne by you unless we specify otherwise.
Products marked as “Final Sale”, “Made-to-Order”, “Customised”, “Monogrammed”, or “Engraved” cannot be returned or exchanged unless required under applicable law.
Once we receive and inspect the returned item(s), we will notify you of the approval or rejection of your refund/exchange. If approved, we will process the refund to the original payment method within 30 business days.
We reserve the right to refuse a return or exchange if the Product is not returned in original condition or packaging, or has been worn, altered, damaged or shows signs of use beyond inspection.
Refunds will be made in U.S. dollars and may not include original shipping costs (unless required by law).
Special luxury-goods considerations: For high-value items (e.g., jewelry, watches, exotic-leather handbags), we may impose additional return/exchange conditions (such as requiring original certificates, serial numbers, seals, packaging) and shorter return periods, as industry practice requires.
A refund of the original purchase price may only be made in the same form of payment, currency, and country/region as the original purchase.
Exports: Clients planning to export items are solely responsible for complying with all applicable laws in connection with such exports.
6. Product Availability & Limits
All Products are subject to availability; we may limit quantities or refuse orders in our sole discretion (for example to prevent reselling, account misuse or fraud).
If you exceed any such purchase limit, we may cancel your Order or adjust the quantity.
If a Product becomes unavailable after you place your Order but before Acceptance, we will notify you and refund any amount paid.
7. Warranty & Disclaimer
We warrant that, at the time of delivery, the Products will (i) conform materially to their description on the Site (including materials, composition and features), and (ii) be free from material defects in workmanship and materials for a period of 12 months.
Our warranty does not cover damage from misuse, normal wear and tear, abuse, unauthorised repair or modification, or exposure to chemicals, extreme conditions or other risks outside normal intended use.
Except as expressly stated in these Purchase Terms or any separate written warranty document, to the fullest extent permitted by law, we disclaim all other warranties (whether express or implied, including merchantability and fitness for a particular purpose).
8. Limitation of Liability
To the maximum extent permitted by law, our total liability arising out of or relating to the Product(s), your Order or these Purchase Terms will not exceed the amount you paid us for the Product(s) in your Order.
We will not be liable for any indirect, incidental, special, punitive or consequential damages (such as loss of profit, loss of goodwill, business interruption) arising out of your purchase or use of our Products.
Nothing in these Purchase Terms limits liability for death or personal injury caused by our negligence, fraud or other liability that cannot be excluded under applicable law.
9. Governing Law & Dispute Resolution
These Purchase Terms and your purchase of Products from JvSv & Co. shall be governed by the laws of the State of Wisconsin, U.S.A., without giving effect to conflict-of-law provisions. Any dispute, claim or controversy arising out of or relating to your Order, these Purchase Terms or any Products purchased shall be subject to the exclusive jurisdiction of the state or federal courts located in Milwaukee, Wisconsin.
10. Changes to these Terms
We may revise these Purchase Terms at any time by posting an updated version on the Site. The version of the Purchase Terms in effect at the time you place your Order will apply to that Order.
